I live in a 2nd floor DDA flat in Delhi. Sewage from the toilet of the flat on the 3rd floor has seeped into my walls and causes a unhygenic stink in my house and has now reached the flat below.The walls have developed cracks and the structure has weakened. The matter is ongoing for 3 years. Electricity supply in my concealed wiring has short circuited creating fire hazard.The owner of the flat above demands money from us to repair the bathroom.
What relief can we obtain under the existing Pollution, Crimminal or Municipal Laws applicable to citizens of Delhi? Which law addresses the willful throwing of sewage into another person’s home?
