A Developer has promoted a large 1500 apartment residential project in Bangalore. The Developer claims that the project is dependent solely on the piped water supply from Bangalore Water Supply and Sewerage Board and he has no back up plan. When pressed to dig bore wells as back up in the event of Bangalore Water Supply and Sewerage Board reneging on the contracted supply or rationing it out in times of scarcity as is usual, the Developer claims he is not permitted to dig bore wells and hence would not do so. That leaves the future residents at the mercy of Tanker suppliers if Bangalore Water Supply and Sewerage Board fails in its commitment.
As a buyer of a flat on the complex I wish to know the following.
a)Is there a ban on digging of borewells for augmenting water supply if Bangalore Water Supply and Sewerage Board fails to supply?
Is the ban permanent or reviewed from time to time?
b)Who is the regulating authority?
c) On the basis of the fact that the Developer has put in place recycling of STP water for flushing purposes and also conserve water by rain water harvesting, we asked him to apply again for permission to dig bore wells purely as "back up" .
He claims to have done so and after four months says the permission is denied again. How to check the veracity of this statement? Can RTI help? Who are the agencies to be approached?
d). Can Bangalore Water Supply and Sewerage Board renege on the supply of agreed quantity without penalty? Or is it beyond the reach of law?
f). If water problem is so acute why and who gives permission for such projects?
